1. Agreement to Terms

Tsingwave (the "Service"), accessible at qingbo.dev, is operated by 清波数景工作室 (Tsingwave Studio) ("Tsingwave", "we", "us", or "our"). By accessing or using the Service, our website, or our API, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with any part of these Terms, you may not access or use the Service.

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Description of the Service

Tsingwave provides a unified API gateway that lets developers access a range of third-party artificial-intelligence models — including chat / large-language models, image-generation, video-generation, and audio models — through a single integration point. The available models, their capabilities, and their pricing are listed on our website and in our API documentation.

Our chat APIs follow an OpenAI-compatible request format to simplify integration; image, video, and audio APIs use the formats described in our documentation. Because the underlying models are developed and operated by third-party providers, the catalog may change at any time — models may be added, updated, renamed, or retired — without prior notice.

3. Service Availability by Region

The Service is intended for developers outside the Chinese mainland and is not available in, or directed to, the Chinese mainland; access from Chinese-mainland IP addresses is blocked. You may not use, or attempt to circumvent regional restrictions to use, the Service from any jurisdiction where it is not offered or where its use is prohibited.

4. Accounts, Authentication, and API Keys

Account registration and sign-in are handled through our identity provider. You must provide accurate, complete, and current information, and keep it up to date. You are solely responsible for safeguarding your account credentials and API keys, and for all activity that occurs under them.

You must not: share your API keys with unauthorized parties; embed keys in client-side or publicly accessible code where they may be exposed; or use your account or keys in any manner that violates these Terms.

5. Acceptable Use

You agree not to use the Service to:

  • violate any applicable law or regulation, or facilitate any illegal activity;
  • infringe the intellectual-property, privacy, publicity, or other rights of any third party;
  • generate, request, or distribute child sexual abuse material, content that sexualizes minors, or any content that exploits or endangers children;
  • generate non-consensual intimate imagery, or deceptive, fraudulent, or impersonating content (including deepfakes) intended to mislead;
  • generate content that is harassing, defamatory, hateful, or that incites violence;
  • transmit malicious code, or attempt to disrupt, compromise, or gain unauthorized access to our infrastructure, other users' accounts, or API keys;
  • exceed, circumvent, or attempt to bypass rate limits, quotas, or usage restrictions;
  • resell, redistribute, sublicense, or white-label the Service without our prior written authorization;
  • scrape, reverse-engineer, or attempt to extract, copy, or replicate the underlying AI models or the Service; or
  • violate the terms, policies, or acceptable-use rules of any underlying third-party model provider.

We may refuse, throttle, or remove access to any request, model, or account that we reasonably believe violates this section.

6. Your Content and Data

As between you and Tsingwave, you retain all rights to the inputs you submit and the outputs generated for you (your "Content"). You grant us a limited, worldwide license to host, process, transmit, and temporarily store your Content solely as necessary to operate and provide the Service.

To fulfil your request, your inputs are transmitted to the third-party model provider you select; that provider's own terms and privacy policies apply to its processing. We do not use your inputs or outputs to train our own AI models, and we do not sell your Content.

You are responsible for ensuring that you have the necessary rights to your inputs and that your use of any outputs complies with applicable law and with the terms of the underlying model provider. AI-generated outputs may be subject to the underlying provider's rules regarding ownership and permitted use.

7. Pricing, Credits, and Billing

The Service operates on a pay-as-you-go basis and is priced in U.S. dollars (USD). You access the Service using a prepaid balance / "Credits", a virtual unit used solely to redeem AI services on the platform. Credits are not a fiat-currency deposit: they are non-withdrawable, bear no interest, and cannot be exchanged or redeemed for cash. The number of Credits required for a given model is determined by us and may be adjusted dynamically based on the model, the upstream provider channel, or operating costs.

You are charged only for successfully completed requests. You are responsible for monitoring your usage, setting any per-key budgets, and for all taxes associated with your use (other than taxes on our net income). Payments are processed by third-party payment providers (for example, Stripe); your use of those services is subject to their terms.

8. No Refunds

All purchases, payments, and Credits are final and non-refundable, except where a refund is required by applicable law. This includes consumed balance, as well as any promotional, bonus, or free-of-charge Credits. You are charged only for successfully completed requests, so failed generations are not billed.

9. Service Availability

We strive to provide a reliable Service but do not guarantee uninterrupted or error-free availability. We may perform maintenance (announced in advance where reasonably possible) and may modify, suspend, or discontinue any endpoint, model, or feature at any time. Rate limits and quotas may be adjusted to maintain service quality.

10. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI outputs are generated by third-party models and may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and validating all outputs before relying on them, particularly in production or high-stakes contexts. We do not warrant the availability, accuracy, or output of any particular model.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Tsingwave SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Tsingwave and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms, applicable law, or any underlying model provider's terms.

13. Intellectual Property

The Service — including its software, API, documentation, design, and features — is owned by Tsingwave and protected by intellectual-property laws. The underlying AI models are owned by their respective providers. You may not copy, modify, distribute, or create derivative works of the Service without our prior written permission. "Tsingwave" and our logos are our trademarks.

14. Termination and Suspension

We may suspend or terminate your account, API keys, and access to the Service, with or without notice, for any breach of these Terms — including violation of the Acceptable Use section, fraud, non-payment, or abuse — or where required by law. We may suspend access immediately where necessary to protect the Service, other users, or to comply with legal obligations. Upon termination, your right to use the Service ceases, but you remain liable for any outstanding charges.

15. API-Specific Terms

By using our API you acknowledge that: (a) outputs are generated by third-party models and may not be accurate or appropriate; (b) you are responsible for validating outputs before production use; (c) rate limits and quotas apply and may vary; (d) we may cache certain responses for performance; (e) you must comply with the terms of the underlying model providers; and (f) you are responsible for any disclosure or labelling of AI-generated content that your jurisdiction requires.

16. Changes to These Terms

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date, and will provide advance notice of material changes (for example by email) where reasonably practicable. Your continued use of the Service after changes take effect constitutes acceptance.

17. Governing Law, Disputes, and Compliance

The governing law and venue for any dispute will be specified in an updated version of these Terms. In the meantime, the parties agree to attempt to resolve any dispute in good faith, on an individual basis.

Local compliance for AI services. You are responsible for ensuring that your access and your generation, use, and distribution of AI-generated content comply with the laws of your jurisdiction — including rules on labelling or disclosing AI-generated content, data-protection laws, and content restrictions. If the laws of your jurisdiction prohibit the use of AI-generation services, you may not use the Service.

Export control and sanctions. You may not access or use the Service in violation of applicable export-control or sanctions laws, and you represent that you are not located in, or acting on behalf of a party located in, a comprehensively sanctioned jurisdiction.

Consumer rights and language. Nothing here removes mandatory consumer-protection rights you have under the laws of your country of residence. These Terms are drafted in English; if a translation is provided, the English version prevails.
